ABSTRACT This article proposes rhetorical hegemony as a new materialist intervention into the production of alternative political economic futures. It problematizes contemporary theories of hegemony that assert affect as beyond rhetorical engagement, suggesting that these accounts fail to produce viable political economic alternatives because they use, but do not reinvent, the prevailing affective relations. Turning to and extending Foucault's middle and late work to forge a different model, the article discusses rhetorical hegemony as the entangled relationships between materiality and power. (...) In conversation with other contemporary theories, it argues for a practice of rhetorical hegemony that materially recapacitates energetic potential and, consequently, the milieu. However, beginning with texts such as Ronald Walter Greene's "Another Materialist Rhetoric" and Jack Selzer and Sharon Crowley's edited collection Rhetorical Bodies, scholars began emphasizing the ontological and embodied rhetoricity of physical contexts and environments over discursive and ideological conceptions of materiality. This turn toward the ontological and embodied has rapidly expanded over the past twenty years, with numerous scholars now offering new materialist, postcritical, ecological, computational, and digital perspectives on rhetoric that privilege concepts such as affect, circulation, and assemblage over more traditional rhetorical terminology.It is in response to this tension between standard rhetorical perspectives and materialist rhetorical approaches that we can appreciate the interventions of S. Scott Graham's recent book, Where's the Rhetoric? Imagining a Unified Field. Rejecting the view that the materialist turns in rhetorical studies (particularly rhetorical new materialisms [hereafter referred to as RNM] and computational rhetoric) have left the discipline more fragmented and less capable of defending a unified perspective on rhetoric, Graham believes it is possible to generate a new unified theory that can affirm the lines of scholarly influence that have given rise to RNM (what Graham calls modern rhetoric's "right branch") as well as the more [End Page 218] traditional lines of scholarly influence that have led to a formulation of rhetoric as "symbolic action" (what Graham calls modern rhetoric's "left branch"). To accomplish this task, Graham argues that we should avoid the tendency to view RNM as "other" to traditional narratives about rhetoric and, instead, consider how these latter perspectives are compatible with the former. Much like unified field theories in physics that seek to bridge older perspectives on general relativity with newer perspectives on quantum mechanics (e.g., string theory and quantum loop gravity), Graham believes it is possible to achieve similar results in rhetorical studies by approaching standard rhetorical perspectives from the ontological viewpoints enabled by RNM.What makes Graham's angle on this claim particularly unique is his premise that a proto-new materialist perspective has underpinned some of the most influential left branch approaches to rhetoric all along. While most rhetoricians start from the present when introducing concepts associated with RNM, Graham, following historically informed thinkers such as Scot Barnett, Debra Hawhee, and Thomas Rickert, demonstrates that there is a line of thinking about "symbolic action" as "situated action" that goes back to the relational approach to metaphysics put forward by philosopher Henri Bergson in the late nineteenth and early twentieth centuries. This volume assembles leading scholars to provide a comprehensive study of representation in music from the nineteenth century to today.

In this paper I identify and respond to four persistent objections to the idea of wilderness: empirical, cultural, philosophical and environmental. Despite having dogged the wilderness debate for decades, none of these objections withstands scrutiny; rather they are misplaced criticisms that hinder fruitful discussion of the philosophical ramifications of wilderness by needlessly complicating the idea itself. While there may be other justifiable concerns about the idea of wilderness, it is time to move beyond the four discussed in this paper.

Scholars and professional organizations in bioethics describe various approaches to “quality assessment” in clinical ethics. Although much of this work represents significant contributions to the literature, it is not clear that there is a robust and shared understanding of what constitutes “quality” in clinical ethics, what activities should be measured when tracking clinical ethics work, and what metrics should be used when measuring those activities. Further, even the most robust quality assessment efforts to date are idiosyncratic, in that they represent (...) evaluation of single activities or domains of clinical ethics activities, or a range of activities at a single hospital or healthcare system. Countering this trend, in this article we propose a framework for moving beyond our current ways of understanding clinical ethics quality, toward comprehensive quality assessment. We first describe a way to conceptualize quality assessment as a process of measuring disparate, isolated work activities; then, we describe quality assessment in terms of tracking interconnected work activities holistically, across different levels of assessment. We conclude by inviting future efforts in quality improvement to adopt a comprehensive approach to quality assessment into their improvement practices, and offer recommendations for how the field might move in this direction. ABSTRACT:Stanley Cavell’s moral perfectionism places the task of cultivating richer self-understanding and self-expression at the center of corporate life. We show how his approach reframes business as an opportunity for moral soul-craft, achieved through the articulation of increasingly reflective inner life in organizational culture. Instead of norming constraints on business activity, perfectionism opens new possibilities for conducting commercial exchange as a form of conversation, leading to personal growth. This approach guides executives in designing businesses that foster genius and channel creativity, (...) while giving all stakeholders a meaningful voice within a culture of trust. We first give an account of Cavellian perfectionism. Then, we explain how this underrepresented strand of moral reflection challenges and enriches, but does not supplant, prevailing ethical theories—including other versions of perfectionism. We then demonstrate the salience of Cavellian perfectionism to business ethics through examples from marketing, human resources, and executive organizational design and development. (shrink)

“A Dialectic of Contrasts” details how the mid-twentieth century American poets Robert Duncan and Denise Levertov employed their understanding of Whitehead’s notion of “contrast” to imagine poems closely linked to ecology and cosmology. Exploring the references to Whitehead’s heterogeneous dialectic of contrasts in the Duncan/Levertov correspondence, the article displays the forcible role Whitehead’s thought played in directing the two poets to a linguistic-organic poetics invested in nonhuman agency.

In both Plato and Thomas Aquinas, we find proposals to understand piety or religion as justice toward God/the gods. One issue with this proposal is what can be called the problem of human-divine reciprocity: Since justice would seem to require human beings to make a return for what they have received from God/the gods, how can this be done without implying God/the gods lack something that human beings can supply? I outline the account of piety/religion as justice toward the divine (...) in both Plato and Aquinas, noting how the reciprocity problem arises along the way. Then I defend a proposed solution drawn from Aquinas: that glory, or the manifestation of divine goodness, is what God seeks in pious human action, yet without implying any benefit to God thereby. Mr. C is a twenty‐two‐year‐old who was flown to a level‐1 trauma center after diving headfirst into shallow water. Prior to this accident, he was in excellent health. At the scene, he had been conscious but was paralyzed and had no sensation below his neck. The emergency medical services team immobilized Mr. C's neck with a cervical collar and intubated him for airway protection before transport. As Mr. C's medical care proceeds, he expresses a desire for extubation, although it was (...) not clear that he had the capacity to make this (or any other) decision. It also was unclear whether this desire reflected his authentic wishes to be allowed to die or stemmed from feelings of discomfort and agitation. Over a period of several days, Mr. C's sedation was lightened, and the psychiatry service conducted a formal decision‐making capacity assessment. Mr. C continues to express a desire to withdraw life‐sustaining medical treatment. With the increasing professionalization of clinical ethics, some hospitals and health systems utilize both ethics committees and professional clinical ethicists to address their ethics needs. Drawing upon historical critiques of ethics committees and their own experiences, the authors argue that, in ethics programs with one or more professional clinical ethicists, ethics committees should be dissolved when they fail to meet minimum standards of effectiveness. In the summer of 2016, the University of Dallas and the Instituto Tecnológico Autónomo de México organized a conference to discuss the topic of the middle class and its continued decline—recognizing that, despite some historical, political and cultural differences, healthy democracies throughout the hemisphere depend upon a strong and prosperous middle class. This volume brings together contributions by nine scholars from both institutions. The chapters reflect diverse disciplinary perspectives that are historical, political, economic, anthropological, and philosophical. A number of articles and empirical studies over the past decade, most by Paul Robinson and co-authors, have suggested a relationship between the extent of the criminal law's reputation for being just in its distribution of criminal liability and punishment in the eyes of the community – its "moral credibility" – and its ability to gain that community's deference and compliance through a variety of mechanisms that enhance its crime-control effectiveness. This has led to proposals to have criminal liability and (...) punishment rules reflect lay intuitions of justice – "empirical desert" – as a means of enhancing the system's moral credibility. In a recent article, Christopher Slobogin and Lauren Brinkley-Rubinstein (SBR) report seven sets of studies that they argue undermine these claims of empirical desert and moral credibility and instead support SBR's proposed distributive principle of "individual prevention," a view that focuses on an offender's future dangerousness rather than on his perceived desert. -/- The idea that there is a relationship between the criminal law's reputation for justness and its crime-control effectiveness did not originate with Robinson and his co-authors. Rather, it has been a common theme among a wide range of punishment theory scholars for many decades. A particularly important conclusion of recent Robinson studies, however, is their confirmation that this relationship is a continuous one: even small nudges in moral credibility can produce corresponding changes in the community's deference to the criminal law. This is important because it shows that even piecemeal changes or changes at the margin – as in reforming even one unjust doctrine or procedure – can have real implications for crime-control. SBR's studies, rather than contradicting the crime-control power of empirical desert, in fact confirm it. Further, SBR's studies do not provide support for their proposed "individual prevention" distributive principle, contrary to what they claim. -/- While SBR try to associate their principle with the popular "limiting retributivism" adopted by the American Law Institute in its 2007 amendment of the Model Penal Code, in fact it is, in many respects, just the reverse of that principle. With limiting retributivism, the Model Code's new provision sets desert as dominant, never allowing punishment to conflict with it. SBR would have "punishment" essentially always set according to future dangerousness; it is to be constrained by desert only when the extent of the resulting injustices or failures of justice is so egregious as to significantly delegitimize the government and its law. This ignores the fact that even minor departures from justice may have an important cumulative effect on the system as a whole. What SBR propose – essentially substituting preventive detention for criminal justice – promotes the worst of the failed policies of the 1960s, where detention decisions were made at the back-end by "experts," and conflicts with the trend of the past several decades of encouraging more community involvement in criminal punishment, not less. While all such frameworks attempt to challenge "the anthropocentric assumption that nonhuman matter is intrinsically passive or non-agential and thus external to or separable from (human) meaning," Figures of Entanglement enters this burgeoning conversation by centering the unique contributions of Karen Barad (xi, x). Readers may recognize this collection from a 2016 special issue of Review of Communication. Yet, with a new foreword by editors Christopher N. Gamble and Joshua S. Hanan and an afterword by Laurie Gries, this collection makes Barad's distinct approach to matter's rhetoricity even more apparent, underscoring its fruitful potential for new materialist rhetorics invested in ethical, political transformation.In the book's foreword Gamble and Hanan differentiate Barad's per-formative new materialism from "vital" as well as what they refer to as "negative" new materialisms to show the generative potential of Barad's framework and the notion of entanglement (x). Other new materialisms tend to be "inclusionary"—add matter and stir—and fail to complicate "the human" itself and its differences (xiv, xi). First, vital and negative new materialisms maintain a distinction between being and knowing, allowing humans to emerge with a unique capacity to "objectively observe and know the existence of something essential, determinate, and unchanging about [End Page 395] reality that precedes and remains unaffected by both its own activities and our observations of it" (xi). On the contrary, Barad's performative approach suggests that "no aspect of reality—including human thought, meaning, and observation—is in any sense external to matter or ever remains entirely unchanged by matter's ongoing performances" (x). Here, humans are not "outside" of observation, but all observation "human or otherwise" co-constitutes what is observed (xi). Second, failing to interrogate "the human" in an attempt to observe matter's vitality is an ethical flaw that makes other approaches less capable of grappling with difference: they have been charged with "erasing associations between race, gender, and matter" and (re)producing a homogenizing, "Western-colonialist notion of humanness" (xiv). In contrast, Barad's is a "thoroughly relational," performative new materialism (1).Barad's concept of "entanglement" draws attention to the indeterminacy of matter and meaning, but it is accompanied by an ethical imperative to examine how difference, human or otherwise, is produced and the implications of power imbalances that arise through these enactments. For Barad, the notion of entanglement does not dissolve difference; difference is what matters. Indeed, they give us a way of thinking about how performative intra-actions produce difference through material-discursive practices, or apparatuses—differences that may be expected but are not inevitable. Rhetorical scholars are therefore invited to interrogate the production of boundaries that cause harm and reconfigure them, rather than assume the discreteness of boundaries from the start. Gamble and Hanan thus make a convincing case for how Barad's work may contribute to important scholarship in decolonial and critical rhetorics for which vital and negative new materialisms are less equipped.Gamble and Hanan utilize the introduction to show how Barad's per-formative new materialism both "supports and affirms" rhetorical materialism, or rhetoric's materiality, and enriches it (5). Ushered in by Michael Calvin McGee, "standard" rhetorical materialism worked to challenge the centuries-old debate about rhetoric's secondary, supplementary status vis-à-vis philosophy by recognizing rhetoric as part of a "shifting and dynamic material history" (6). Building upon this view, Ronald Walter Greene utilizes Foucault's notion of the apparatus to demonstrate how even the "material history" McGee called our attention to is itself "produced by apparatuses"—history is not "outside" of meaning (6). We argue that any strong version of a knowledge condition on intentional action, the practical knowledge principle, on which knowledge of what I am doing (under some description: call it A-ing) is necessary for that A-ing to qualify as an intentional action, is false. Our argument involves a new kind of case, one that centers the agent’s control appropriately and thus improves upon Davidson’s well-known carbon copier case. After discussing this case, offering an initial argument against the knowledge condition, and (...) discussing recent treatments that cover nearby ground, we consider several objections. One we consider at some length maintains that although contemplative knowledge may be disconnected from intentional action, specifically practical knowledge of the sort Anscombe elucidated escapes our argument. We demonstrate that this is not so. Our argument illuminates an important truth, often overlooked in discussions of the knowledge-intentional action relationship: intentional action and knowledge have different levels of permissiveness regarding failure in similar circumstances. In this interesting paper, Lavazza and Massimini draw attention to a subset of the ethical issues surrounding the development and potential uses of cerebral organoids. This subset concerns the possibility that cerebral organoids may one day develop phenomenal consciousness, and thereby qualify as conscious subjects—that there may one day be something it is like to be an advanced cerebral organoid. This possibility may feel outlandish. But as Lavazza and Massimini demonstrate, the science of organoids is moving fast, and I agree (...) that the ethical issues now deserve careful scrutiny. The ethical issues are not entirely separate from epistemological issues concerning how certain we could ever be (a) that an organoid is conscious or (b) that regarding any conscious state or process, an organoid is capable of tokening that state or undergoing that process. Lavazza and Massimini’s approach is theory-based—they claim that ‘we need a general theory of consciousness that attempts to explain what experience is and what type of physical systems can have it’. I am not convinced, however, that a theory of consciousness is what we need. Nor am I convinced that detecting the presence of consciousness is the most important moral issue. Let me say a word regarding theories of consciousness first. In general, to the extent that pervasive disagreement characterises expert discussion of some phenomenon P, one should modify one’s credence downward regarding any theory of the nature of P. It is well known that the nature of consciousness is elusive, and that attempts to understand it generate problems in metaphysics, philosophy of mind, psychology, and neuroscience. Less appreciated are the important – even if still elusive – connections between consciousness and issues in ethics. In this chapter we consider three such connections. First, we consider the relevance of consciousness for questions surrounding an entity’s moral status. Second, we consider the relevance of consciousness for questions surrounding moral responsibility for action. (...) I offer an account of the experience of acting that demonstrates how agentive aspects of experience associated with the execution of intentions are richly integrated with perceptual aspects associated with parts of action taking place in the publicly observable world. On the view I elucidate, the experience of acting is often both an engagement with the world and a type of intimate acquaintance with it. In conscious action the agent consciously intervenes in the world and consciously experiences the world she (...) is changing. In section one, I discuss extant accounts of the experience of acting, noting deficiencies. This paper aims to expand the range of empirical work relevant to the extended cognition debates. First, I trace the historical development of the person-situation debate in social and personality psychology and the extended cognition debate in the philosophy of mind. Next, I highlight some instructive similarities between the two and consider possible objections to my comparison. I then argue that the resolution of the person-situation debate in terms of interactionism lends support for an analogously interactionist conception of extended cognition. (...) I argue that this interactionism might necessitate a shift away from the dominant agent-artifact paradigm toward an agent–agent paradigm. If this is right, then social and personality psychology—the discipline(s) that developed from the person-situation debate—opens a whole new range of empirical considerations for extended cognition theorists which align with Clark & Chalmers original vision of agents themselves as spread into the world. In this paper, I examine the claim that self-consciousness is highly morally significant, such that the fact that an entity is self-conscious generates strong moral reasons against harming or killing that entity. This claim is apparently very intuitive, but I argue it is false. I consider two ways to defend this claim: one indirect, the other direct. The best-known arguments relevant to self-consciousness's significance take the indirect route. I examine them and argue that in various ways they depend on unwarranted (...) assumptions about self-consciousness's functional significance, and once these assumptions are undermined, motivation for these arguments dissipates. I then consider the direct route to self-consciousness's significance, which depends on claims that self-consciousness has intrinsic value or final value. I argue what intrinsic or final value self-consciousness possesses is not enough to generate strong moral reasons against harming or killing. (shrink)

The chief themes of this discussion are as follows. First, we need a theory of the grounds of moral status that could guide practical considerations regarding how to treat the wide range of potentially conscious entities with which we are acquainted – injured humans, cerebral organoids, chimeras, artificially intelligent machines, and non-human animals. I offer an account of phenomenal value that focuses on the structure and sophistication of phenomenally conscious states at a time and over time in the mental lives (...) of conscious subjects. Second, we need to map a theory of moral status onto practical considerations. I prefer the precautionary framework proposed by many, and fruitfully precisified recently by Birch. I have suggested that in addition to further discussion surrounding the evidential bar for attributing consciousness to different types of entities, more discussion is needed regarding how value and moral status may vary across different entity-types, and regarding the sources of value in an entity’s mental life. BackgroundThe COVID-19 crisis has introduced a variety of stressors, while simultaneously decreasing the availability of strategies to cope with stress. In this context, it could be useful to understand issues that people find most concerning and ways in which they cope with stress. In this study, we explored these questions with a sample of graduate and professional students.MethodUsing open-ended assessments, we asked participants to identify their biggest challenge or concern, their most effective way of handling stress, and their most common (...) way of handling stress. We applied thematic analysis and evaluated whether participants’ strategies corresponded with evidence-based practices.ResultsParticipants frequently reported top problems relating to productivity, physical health, and emotional health. Distraction was the most frequently classified common strategy, whereas behavioral activation was the most frequently identified effective strategy. Participants who reported a common strategy classified as an EBP reported lower depressive and anxiety symptoms. In contrast, there was no evidence of an association between symptom levels and whether or not participants’ effective strategy was an EBP. Participants who reported the same strategy as both their common and effective strategy reported lower depressive symptoms than those whose common and effective strategies were different.ConclusionOur findings highlight stressors that students are experiencing and ways they are coping during the COVID-19 crisis. We discuss how these findings can inform mental health promotion efforts and future research on coping with stressors. (shrink)

The flow construct has been influential within positive psychology, sport psychology, the science of consciousness, the philosophy of agency, and popular culture. In spite of its longstanding influence, it remains unclear [a] how the constituents of the flow state ‘hang together’—how they relate to each other causally and functionally—[b] in what sense flow is an ‘optimal experience,’ and [c] how best to describe the unique phenomenology of the flow state. As a result, difficulties persist for a clear understanding of the (...) flow state’s structure and function. After explicating the standard view of the flow construct, I articulate several basic questions regarding its nature and functional roles, and I argue that these questions are best answered by integrating flow within broader streams of research on the dynamics of thought, on cognitive control resource allocation, and on creative thought. Benchmarks against which healthcare ethics consultation (HCEC) services can assess their performance are needed. As first-generation benchmarks continue to be developed, it is the obligation of the field to continually evaluate how these measures reflect the performance of any single HCEC service. This will be possible only with widespread reporting of standardized data points. In their article in this issue of The Journal of Clinical Ethics, Glover and colleagues provide a valuable preliminary approach for assessing appropriate consult volumes for a (...) HCEC service. The limitations of their study read as a call to action for the field of clinical ethics to expand and standardize data reporting so that more robust metrics can be developed. In response to this call by Glover and colleagues, the Cleveland Clinic HCEC service provides consult data from 2015 through 2019 for one of its medical centers, and offers an additional volumebased metric, consult-to-ICU-to-bed ratio (CiBR), that may add nuance to any normative assessment of HCEC service consult volume. Given that volume-based metrics are the native language of the clinical environment, efforts to improve such metrics in the field through transparency and standardization are warranted. However, the expositive power of volume-based metrics is limited; additional domains related to quality and outcomes are needed. (shrink)

Strong Composition as Identity is the thesis that necessarily, for any xs and any y, those xs compose y iff those xs are non-distributively identical to y. Some have argued against this view as follows: if some many things are non-distributively identical to one thing, then what’s true of the many must be true of the one. But since the many are many in number whereas the one is not, the many cannot be identical to the one. Hence is mistaken. (...) Although I am sympathetic to this objection, in this paper, I present two responses on behalf of the theorist. Successful therapies to combat microbial diseases and cancers require incorporating ecological and evolutionary principles. Drawing upon the fields of ecology and evolutionary biology, we present a systems‐based approach in which host and disease‐causing factors are considered as part of a complex network of interactions, analogous to studies of “classical” ecosystems. Centering this approach around empirical examples of disease treatment, we present evidence that successful therapies invariably engage multiple interactions with other components of the host ecosystem. Many of these factors interact (...) nonlinearly to yield synergistic benefits and curative outcomes. We argue that these synergies and nonlinear feedbacks must be leveraged to improve the study of pathogenesis in situ and to develop more effective therapies. An eco‐evolutionary systems perspective has surprising and important consequences, and we use it to articulate areas of high research priority for improving treatment strategies. (shrink)

: I focus on Uriah Kriegel’s account of conative phenomenology. I agree with Kriegel’s argument that some conative phenomenology is primitive in that some conative phenomenal properties cannot be reduced to another kind of property. I disagree, however, with Kriegel’s specific characterization of the properties in question. Kriegel argues that the experience of deciding-and-then-trying is the core of conative phenomenology. I argue, however, that the experiences of trying and acting better occupy this place. Further, I suggest that the attitudinal component (...) of the experiences of trying and acting is not, as Kriegel suggests, best characterized in terms of commitment to the rightness or goodness of the objects of experience. Rather, I argue that the attitudinal component is best characterized in imperatival terms. Mentre condivido la tesi di Kriegel, secondo cui parte della fenomenologia conativa è primitiva, nel senso che parte delle proprietà fenomeniche conative non possono essere ridotte ad altri tipi di proprietà, debbo tuttavia dissentire riguardo la specifica caratterizzazione data da Kriegel delle proprietà in questione. Kriegel ritiene che l’esperienza del decidere-e-poi-sforzarsi sia il nucleo della fenomenologia conativa. Io direi tuttavia che le esperienze dello sforzo e dell’azione occupano meglio questa posizione. Inoltre, suggerirei che la componente relativa all’atteggiamento delle esperienze dello sforzo e dell’azione non sia descrivibile al meglio, come suggerisce Kriegel, in termini di impegno legato all’adeguatezza o all’integrità dell’oggetto d’esperienza. In online social networks, the audience size commanded by an organization or an individual is a critical measure of that entity’s popularity and this measure has important economic and/or political implications. Such efforts to measure popularity of users or exploit knowledge about their audience are complicated by the presence of fake profiles on these networks. In this study, analysis of 62 million publicly available Twitter user profiles was conducted and a strategy to identify automatically generated fake profiles was established. Using (...) a combination of a pattern-matching algorithm on screen-names and an analysis of update times, a reasonable number of highly reliable fake user accounts were identified. Analysis of profile creation times and URLs of these fake accounts revealed their distinct behavior relative to a ground truth data set. The characteristics of friends and followers of users in the two data sets further revealed the very different nature of the two groups. The ratio of number of followers-to-friends for ground truth users was ∼1, consistent with past observations, while the fake profiles had a median ratio ∼30, indicating that the fake users we identified were primarily focused on gathering friends. An analysis of the temporal evolution of accounts over 2 years showed that the friends-to-followers ratio increased over time for fake profiles while they decreased for ground truth users. Our results, thus, suggest that a profile-based approach can be used for identifying a core set of fake online social network users in a time-efficient manner. (shrink)

This article aims to provide a defense of the coherence of the doctrine of middle knowledge against the Grounding Objection. A solution to the Grounding Objection is provided by utilising the metaphysical thesis of Modal Realism proposed by David K. Lewis (as further developed by Kris McDaniel and Philip Bricker). Utilising this metaphysical thesis will enable the Counterfactuals of Creaturely Freedom, that are part of God’s middle knowledge, to have pre-volitional truthmakers, and thus, ultimately, we will have a means to (...) finally deal with this problematic issue that has often been raised against this doctrine. Timothy Williamson has argued for the radical conclusion that everything necessarily exists. In this paper, I assume that the conclusion of Williamson’s argument is more incredible than the denial of his premises. Under the assumption that Williamson is mistaken, I argue for the claim that there are some structured propositions which have constituents that might not have existed. If those constituents had not existed, then the propositions would have had an unfilled role; they would have been gappy. This gappy propositions (...) view allows for a plausible response to Williamson’s argument. Additionally, a slight variant of the gappy propositions view allows for plausible defense of Linguistic Ersatzism from the problem of contingent non-existents (also known as the problem of aliens). In this chapter, I argue that despite Rorty and MacIntyre’s shared historicism, critics are right to claim that Rorty is more of a relativist than MacIntyre because the latter provides a more substantial conception of rational progress. At its most fundamental, MacIntyre’s inter-tradition conception of rational progress recognizes incoherence as a general ill and the pursuit of truth as a general good, whereas the specter of incommensurability precludes Rorty from establishing generalities regarding progress. Thus, after a brief introduction I present (...) the key points of confluence found in Rorty’s and MacIntyre’s respective conceptions of historicism focusing on their conceptions of “justification” and “rationality” as well as their attempts to reject the charge of relativism. Then I show how MacIntyre’s conception of rational progress and the role he envisions for truth as the ideal end of enquiry set him apart from Rorty. Finally, I conclude that these differences make MacIntyre less susceptible to the charge of relativism and that this, in turn, makes his conception of progress more alluring than Rorty’s. (shrink)

Definitions of death are often referred to as legal fictions since brain death was conceived in the mid-twentieth century. Reference to legal fiction is generally paired with bioethicists’ concern that it facilitates post-mortem tissue donation and the health system generally, by determining death earlier on the continuum of dying and availing more viable tissue and therapeutic resources for others. The author argues that spatio-legal theory, drawing from legal geography, can account for the heterogeneity of effects that the fiction has in (...) spatially managing bodies (e.g., physicians, patient, family) at the bedside. The legal fiction is produced in physicians’ socio-legal practices, coordinating decision-making according to geographies of scarcity and severable, self-contained live- and dead-bodies. The determination liminally exists between private and public, enacting a sterile, affectless ordering of bodies but administered in the spectacle of sovereign death-making, conveying authority whilst managing patient’s and family’s consents. Spatialising traces of anatamo-politics and biopolitics thereby congeal and are enacted heterogeneously in and through the legal form of the fiction, securing preferred constructions of the body in the management of mortality. These spatio-legal features of the legal fiction are described from their collision with case law and literature that document competing nomoi produced from or secreted by antinomian bodies. The COVID-19 outbreak has simultaneously increased the need for mental health services and decreased their availability. Brief online self-help interventions that can be completed in a single session could be especially helpful in improving access to care during the crisis. However, little is known about the uptake, acceptability, and perceived utility of these interventions outside of clinical trials in which participants are compensated. Here, we describe the development, deployment, acceptability ratings, and pre–post effects of a single-session intervention, the Common Elements (...) Toolbox, adapted for the COVID-19 crisis to support graduate and professional students. Participants, who were not compensated, were randomly assigned to two of three modules: behavioral activation, cognitive restructuring, and gratitude. Over 1 week, 263 individuals began and 189 individuals completed the intervention. Participants reported that the intervention modules were acceptable, helpful, engaging, applicable to their lives, and could help them manage COVID-related challenges. Participants reported pre- to post-program improvements in secondary control and in the perceived negative impact of the COVID-19 crisis on their quality of life. On average, differences in their perceived ability to handle lifestyle changes resulting from the pandemic were positive, but small and at the level of a non-significant trend. Our results highlight the acceptability and utility of an online intervention for supporting individuals through the COVID-19 crisis. (shrink)
